Brigitte Seroussi, responsable de la cellule \u00e9thique du num\u00e9rique en sant\u00e9 \u00e0 la DNS et professeure des universit\u00e9s-praticienne hospitali\u00e8re, dirige la cellule \u00e9thique du conseil du num\u00e9rique en sant\u00e9, agenc\u00e9e selon plusieurs groupes de travail. C\u2019est le groupe de travail n\u00b03, anim\u00e9 par David Gruson, sp\u00e9cialiste et directeur du programme sant\u00e9 de Luminess, qui est \u00e0 l\u2019origine de ce guide m\u00e9thodologique. Son but est d\u2019int\u00e9grer l\u2019\u00e9thique d\u00e8s le d\u00e9veloppement des solutions d\u2019IA, ce qu\u2019on appelle\u00a0\u00ab\u00a0<\/em>l\u2019<\/em>\u00e9thique by design\u00a0\u00bb<\/em>.<\/p>\n

Ce rapport est l\u2019aboutissement d\u2019une concertation des diff\u00e9rentes parties prenantes de l\u2019\u00e9cosyst\u00e8me de la sant\u00e9 num\u00e9rique. Il concr\u00e9tise une d\u00e9marche de deux ans pendant lesquels les travaux de la cellule \u00e9thique ont associ\u00e9 des experts pluri-professionnels avec des chercheurs en IA, des repr\u00e9sentants de patients, des professionnels de sant\u00e9, des juristes, des sociologues, des \u00e9thiciens, etc. On retrouve parmi eux Emeline Brule (\u00c9cole d\u2019ing\u00e9nierie et d\u2019informatique, Universit\u00e9 du Sussex), Madeleine Cavet (M\u00e9decin radiologue), Caroline Guillot (Health Data Hub) mais \u00e9galement Daniela Parrot (D\u00e9l\u00e9gu\u00e9e \u00e0 la protection des donn\u00e9es, Minist\u00e8re des solidarit\u00e9s et de la sant\u00e9) et Philippe Lamoureux (LEEM). Ensemble, ils ont \u00e9tabli ces recommandations de bonnes pratiques, qui visent \u00e0 int\u00e9grer l\u2019\u00e9thique d\u00e8s les premi\u00e8res \u00e9tapes du d\u00e9veloppement des solutions d\u2019IA en sant\u00e9.<\/p>\n

Ce livre blanc s\u2019adresse\u00a0\u00ab\u00a0<\/em>en priorit\u00e9\u00a0\u00bb<\/em>\u00a0aux concepteurs de solutions bas\u00e9es sur des algorithmes entra\u00een\u00e9s \u00e0 partir de l\u2019extraction massive de donn\u00e9es, hors syst\u00e8mes \u00e9volutifs auto-apprenants.<\/p>\n

Le processus d\u2019\u00e9laboration d\u2019une solution d\u2019IA comporte de nombreuses \u00e9tapes : cadrage, collecte des donn\u00e9es, pr\u00e9traitement des donn\u00e9es, construction de l\u2019algorithme et \u00e9valuation de l\u2019algorithme en amont de la mise en production de la solution num\u00e9rique. Des questionnements \u00e9thiques propres \u00e0 chacune de ces \u00e9tapes ont \u00e9t\u00e9 propos\u00e9s, c\u2019est ce que les experts ont d\u00e9sign\u00e9 comme une conception \u00ab by design \u00bb. Par exemple, les fournisseurs devront effectuer une d\u00e9claration de conformit\u00e9 et s\u2019assurer que le syst\u00e8me d\u2019IA \u00e0 haut risque fait l\u2019objet d\u2019un marquage CE avant toute mise sur le march\u00e9. A chaque modification de celui-ci, une nouvelle \u00e9valuation de conformit\u00e9 devra \u00eatre r\u00e9alis\u00e9e.<\/p>\n

Certaines recommandations sont d\u2019ailleurs d\u00e9j\u00e0 entr\u00e9es dans le droit national et europ\u00e9en. On peut citer notamment la loi n\u00b0 2021-1017 du 2 ao\u00fbt 2021 relative \u00e0 la bio\u00e9thique, qui a introduit une obligation d\u2019information \u00e0 la charge des professionnels utilisant une IA en mati\u00e8re de sant\u00e9.<\/p>\n<\/div>\n<\/div>\n<\/div>\n
